These Terms of Service ("Terms", "Agreement") govern your access to and use of all products provided by Breadbyte Cloud - Thomas Neumann (hereinafter "we", "us" or "our"). By accessing, registering or using any of our hosting or related services, you agree to be bound by these Terms.
We prohibit these use cases on all of our services:
No uptime guarantee or technical support SLA is provided.
By ordering our services, you accept that we activate products within 24 hours and you waive your right of withdrawal and refund after your service has been provisioned. In case you are not happy with your ordered service contact us. Depending on your case we will be able to process a full or partial refund.
You agree to pay for all orders made from your Account in accordance with the prices and billing terms in effect at the time an order is made from your Account. We only allow payments in EUR via PayPal, Stripe, Mollie or to our bank account. You can submit a payment in our billing panel. By adding a payment method to your Account you grant us a mandate to charge your payment methods in accordance with your services and billing terms. All prices are final. In accordance with §19 of the German VAT Act (UStG), no VAT is charged or shown (small business regulation). We will send you an invoice 7 days before your services are due, and a reminder 3 days before the due date. We will temporarily suspend your service and inform you via email if the payment is due for 3 days. If the payment is due for 14 days in total we will permanently terminate your services and your account. We reserve the right to collect any outstanding payment due, and may transfer the collection of your outstanding balance to a third party collection agency.
We only provide the technical infrastructure for your services. You remain liable for managing, securing and backing up your services.
Either party may terminate the service by providing 30 days’ notice to the other party. In addition, either party may terminate the service immediately in the event of a breach of these Terms, provided that the breaching party has been notified of the breach and fails to remedy it within a reasonable period, if applicable. Termination does not affect any rights or obligations accrued prior to termination.
We reserve the right to change this ToS at any time. Customers will be notified of any changes via email and through an announcement in our billing panel. If the customer does not object to the changes within four weeks, the changes will be considered accepted.
The processing of personal data is carried out in accordance with the applicable General Data Protection Regulation (GDPR). Further information can be found in the separate Privacy Policy.
If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain in full force and effect.
The European Commission provides a platform for online dispute resolution (ODR), available at https://ec.europa.eu/consumers/odr. We are not obliged and do not intend to participate in any dispute resolution proceedings before a consumer arbitration board."
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Halle (Saale), unless mandatory statutory provisions provide otherwise.
